Guardian Council contradicts judiciary over supervision of Leader

Judiciary head denies Assembly of Experts can oversee Supreme Leader

One day after the head of Iran’s judiciary denied there was any constitutional basis to argue that the Assembly of Experts has supervisory authority over the Supreme Leadership, a member of the Guardian Council, Iran’s constitutional watchdog, says the assembly should in fact monitor the highest authority in the land.

Ayatollah Mohammad Momen told the Mehr News Agency on Tuesday December 15 that the Assembly of Experts should continue to monitor the criteria of leadership so it can dismiss the leader in the event those criteria are no longer met.

He added: “The Assembly of Experts has jurisdiction over the appointment of the leader and his introduction to the people, and following the appointment of the leader, it has to maintain supervision over the actions of the leader.”

The head of Iran’s judiciary said in a meeting yesterday that the constitution does not give the Assembly of Experts the authority to supervise the actions of the Supreme Leader as indicated in some media reports. He said the constitution only gives the assembly the power to monitor the conditions of the leader’s appointment.

The Assembly of Experts elections will take place in March.
